Pre-Nuptial Agreements

A pre-nuptial agreement is entered into prior to marriage to define your financial expectations once you are married. It makes sense to consider one if either or both of you are bringing substantial assets or debts into the marriage; if either of you has children from a previous marriage; if either of you stands to inherit significant assets from family; or if one or both of you wish to protect a business. You may also have additional, unique reasons for creating such an agreement.

A prenuptial agreement is a legally binding contract that outlines the rights and obligations of each party in the event of divorce or death.

At the New York Divorce Mediation Group, and are located in Long Island or New York State, we can assist you through the mediation process to reach an agreement, or we can represent you and work collaboratively with your future spouse’s attorney to prepare a prenuptial agreement that meets both your needs and expectations.

Post-Nuptial Agreements

Sometimes married couples wish to clarify their financial expectations in the event of an eventual separation or divorce. Entering a post-nuptial agreement. will reduce the conflict over financial issues in the event of a separation or divorce. Spouses may also want to create a post nuptial agreement if one spouse receives a large inheritance or business interest or to update a pre-nuptial agreement. For stay-at-home spouses, a post-nuptial agreement will ensure that their financial needs will be met in the event of a separation or divorce.

Post-Nuptial agreements will address the distribution of assets and debts; the payment or waiver of spousal support; determine any interest in a business and the distribution or waiver of each spouse’s retirement plans.

A post-nuptial agreement is legally binding contract that is entered into after full disclosure of the parties’ assets and liabilities. It must be in writing and properly signed by both spouses.
